Weekly European data sovereignty brief for the window Monday 24 August 2026 to Monday 31 August 2026. A quiet week inside the EU institutions' late-August lull: no Tier 1 policy action and no Tier 2 market move dated inside the window, with the DPF adequacy and Cloud and AI Development Act threads held on the watchlist.

Checked in this window and found nothing dated inside it: European Commission press corner (tech sovereignty, digital, justice and data protection, competition portfolios), EUR-Lex recent acts, Have Your Say consultations, Council of the EU press releases, European Parliament ITRE/LIBE/IMCO output, EDPB and EDPS publications, CJEU press releases, ENISA and the EUCS certification scheme, and the national authorities on the watch list (CNIL/ANSSI, BfDI/BSI, Autoriteit Persoonsgegevens, AEPD, Swiss FDPIC, UK ICO). This sits inside the EU institutions' late-August lull, which likely explains the silence rather than any underlying calm in the file.

The two biggest live threads on the CLOUD Act/extraterritoriality narrative both predate this window and had no dated follow-on this week.

  • The Cloud and AI Development Act (CADA): Commission proposal COM(2026) 502, published 3 June 2026. Stage: proposal, now in Parliament/Council negotiation.   • EU-US Data Privacy Framework under pressure from Trump v. Slaughter: the EDPB sent the European Commission a letter dated 31 July 2026 asking it to "closely assess" whether the US Supreme Court's ruling (removing FTC Commissioner Slaughter on grounds that arguably conflict with the DPF's independence commitments) undermines the adequacy decision. noyb separately wrote to the Commission on 29 June 2026 calling for an "orderly withdraw[al]" of the adequacy decision and said it intended to file for CJEU annulment "in the coming weeks." Both are outside this week's window and I could not confirm noyb has actually filed suit yet, so this stays a watchlist item, not a policy movement, until there is a dated filing or a Commission response. 3. Market moves

None dated inside the window. The most recent European-provider sovereignty news I could verify (nLighten/Arqit confidential computing PoC, 14 July 2026; the Commission's EUR 180m sovereign cloud tender to OVHcloud, Scaleway, STACKIT and T-Systems, awarded 17-20 April 2026) is weeks to months old and already reflected in prior planning. Nothing new from OVHcloud, IONOS, Scaleway, Exoscale, StackIT, Impossible Cloud, Gaia-X, CISPE or EuroStack this week.

4. Worth reading

Nothing qualifies. I did not find commentary from Euractiv, Politico, MLex, Netzpolitik, Contexte, Data Center Dynamics, The Register, noyb or national regulators dated inside the window that adds a genuinely new angle. Padding with older pieces already covered in past cycles would misrepresent the week.

5. Watchlist

  • noyb v. Commission (threatened): noyb said on 29 June 2026 it would seek CJEU annulment of the DPF adequacy decision "in the coming weeks." No confirmed filing as of this run. Watch for the actual filing and case number.
  • Latombe v. Commission appeal (Case T-553/23, on appeal): The General Court dismissed Latombe's challenge to the DPF adequacy decision on 3 September 2025; the Court of Justice accepted the appeal (reported November 2025). No hearing date has been published yet. This is the more advanced of the two DPF legal threats and worth checking weekly.
  • EDPB/Commission response to the 31 July 2026 letter: No public Commission reply found yet. A formal review or statement here would be a genuine policy movement worth flagging immediately when it lands.
  • Cloud and AI Development Act: In Parliament/Council negotiation following the 3 June 2026 proposal. No committee vote date confirmed; worth rechecking ITRE committee calendar as the EU institutions return from the August lull.
  • EU institutional calendar: European Parliament and Commission activity typically resumes from the summer recess in early September. Expect this file to become more active over the next few weekly cycles.

  • Whether noyb has filed its threatened CJEU annulment action against the DPF adequacy decision: could not confirm a filing date or case number as of 31 August 2026.
  • A confirmed hearing or ruling date for the Latombe appeal at the Court of Justice: not published as of this run.
